 BOARD OF ZONING APPEALS PUBLIC NOTICE

 

NOTICE IS HEREBY GIVEN that the Board of Zoning Appeals of the Inc. Village of  Brightwaters will hold a public hearing on  Wednesday August 16, 2017 7:30pm at Village Hall, 40 Seneca Drive, Brightwaters, NY to consider the following application for variance relief:

Peter & Virginia Agola, 511 Potter Boulevard, Brightwaters, NY 11718 seek permission to construct an 8’-9” wide x 4’-7” deep portico on front of house in violation of Village Code Section 128-22 which requires a building to be set back from a front property line a distance of 2 feet greater than the average setback of existing buildings within the block in question and on the same side of the street. The average setback on block is 32.93 ft. which results in a required setback of 34.93 ft.  Application calls for front yard setback of 29 ft. (existing setback is 34.5ft.).

All applicants or their duly authorized representative are required to be at this hearing at the time specified above.  All interested parties are welcome and will be given an opportunity to be heard.

LEGAL NOTICE

NOTICE OF PUBLIC HEARING ON PROPOSED LOCAL LAWS AND REGULAR MEETING OF THE BOARD OF TRUSTEES

 

PLEASE TAKE NOTICE that the Board of Trustees of the Village of Brightwaters will hold two public hearings at 8:00pm on Wednesday, July 5, 2017 at Village Hall, 40 Seneca Drive, Brightwaters, New York 11718, with respect to the proposed new Local Laws, as follows:

  1. Local Law 4-2017 - to regulate or prohibit the planting and/or growing of bamboo within the Village; and,
  2. Local Law 5-2017 - to reduce the speed limit in the entire Village from 30 to 25 MPH.

PLEASE TAKE FURTHER NOTICE that at said hearings all interested parties will be given an opportunity to be heard on said proposed Local Law(s) at the place and time aforesaid. Copies of the proposed Local Law(s) will be available at the Village Hall at least five (5) days before the public hearing and may be seen during the regular business hours. 

NOTICE IS HEREBY GIVEN, pursuant to the requirements of the Open Meetings Law of the State of New York, that the Board of Trustees of the Village of Brightwaters will, immediately following the Public Hearings, convene at the place and time aforesaid for the purpose of conducting a regular monthly meeting for its general business. 

Those persons planning to attend the meeting and who require special accommodations because of a disability are requested to notify the Village Clerk no less than 48 hours prior to the meeting.

NOTICE IS HEREBY GIVEN that the Board of Zoning Appeals of the Inc. Village of  Brightwaters will hold a public hearing on  Wednesday June 21, 2017 7:30pm at Village Hall, 40 Seneca Drive, Brightwaters, NY to consider the following applications for variance relief:

Thomas & Frances Voorhees, 13 South Bay Court, Brightwaters,  NY 11718 seeks permission to construct a breezeway and garage in violation of Village Code Sections 128-29 A which limits the total building area to 20% of the lot area.  Application calls for 23.3% (19.7% existing).  Village Code Section 128-10, which requires a minimum roof pitch of five on twelve (5/12).  Application calls for three and one half on twelve (3.5/12) and Village Code Section 128-31 B(1) which requires a building to be set back a minimum of 50 feet from a rear property line; application calls for a setback of 42.75 feet.  This is a Re-Hearing of this case.  No Decision had been rendered.

Bernadette & David Whitwell, 52 South Windsor Avenue, Brightwaters, NY 11718 seeks permission to construct a second floor addition in violation of Village Code Section 128-10 which requires a minimum roof pitch of five on twelve (5/12); application calls for three on twelve (3/12) pitch.

Federico Campbell, 134 Bay Way Avenue, Brightwaters, NY 11718 seeks permission to construct a one story addition in violation of Village Code Section 128-29(A) which limits the total building area to 20% of the lot area.  Application calls for 20.9%.  Violation of Village Code Section 128-10- which requires a minimum roof pitch of five on twelve (5/12), application calls for three on twelve (3/12) pitch.
