INCORPORATED VILLAGE OF BRIGHTWATERS  ZONING BOARD OF APPEALS NOTICE OF PUBLIC HEARINGS

 

                NOTICE IS HEREBY GIVEN that the Zoning Board of Appeals of the Inc. Village of Brightwaters will hold a public hearing using the computer program ZOOM MEETING on Wednesday April 28, 2021 at 7:30pm at Village Hall, 40 Seneca Drive, Brightwaters, New York 11718, to consider the following applications for variance relief:

Mr. & Mrs. Christopher Leone, 58 Hiawatha Drive, Brightwaters, NY 11718 seek permission to construct patios and garden walls in the rear yard in violation of Village Code Section 128-29A which limits the total building area (FAR) to 20% of the lot area, Applicants proposing 25.23%.  In violation of Village Code Section 128-31D, which limits the total rear yard building area (GAR) to 35% of the rear yard area, Applicants proposing 38.04%.  

Mr. Christopher Moro and Ms. Colleen Riley, 153 Concourse West, Brightwaters, NY 11718 seek permission to construct an elevated terrace in the front yard in violation of Village Code Section 128-22 A(1) which requires a building to be set back from a front property line a distance of 2 feet greater than the average setback of existing buildings within the block in question and on the same side of the street.  The required setback is 38.63 ft., Applicants proposing a front yard setback of 33.8 ft. (existing house setback = 43.7 ft., existing patio setback = 33.8 ft.). 

Mr. Joseph Walsh, 345 Woodland Drive, Inc., 360 Route 109, West Babylon, NY 11704 seeks permission to construct a covered front porch, detached garage, and rear yard patio on the premises located at 345 Woodland Drive, Brightwaters, NY 11718 in violation of Village Code Section 128-22 A(1) which requires a building to be set back from a front property line a distance of 2 feet greater than the average setback of existing buildings within the block in question and on the same side of the street.  The required setback is 42.57 ft., Applicant proposing a front yard setback of 37.67 ft. (existing setback = 43.30 ft.)  In violation of Village Code Section 128-29A which limits the total building area (FAR) to 20% of the lot area, Applicant proposing 24.36%.

Mr. Michael Mangan, 110 Hiawatha Drive, Brightwaters, NY 11718 seeks permission to maintain a swimming pool, decks, side yard patio, and two sheds in violation of Village Code Section 128-29A which limits the total building area (FAR) to 20% of the lot area, Applicant proposing 23.7%.  In violation of Village Code Section 128-32C which requires accessory buildings to be at least 10 feet from side and rear property lines, Applicant proposing a side yard setback of 1.6 ft.

Mr. Paul Galvin, 424 Peters Blvd., Brightwaters, NY 11718 seeks permission to construct an in-ground swimming pool in violation of Village Code Section 128-29A which limits the total building area (FAR) to 20% of the lot area, Applicant proposing 25.51%.  In violation of Village Code 128-31D which limits the total rear yard coverage (GAR) to 35%, Applicant proposing 66.21%. 

SLA Irrevocable Trust, c/o Dynamic Design & Permits, Inc., 20 Waterford Drive, Wheatley Heights, NY 11798 seeks permission to construct new fences on the property located at 455 Lombardy Blvd., Brightwaters, NY 11718 in violation of Village Code Section 128—26A(2) which prohibits a fence from being constructed nearer a street than the front line of the building, Applicant proposing a fence to be constructed 15 ft. from the Lombardy Blvd. property line, where the building setback is approximately 32 ft.

Mr. Richard Racanelli, 37 Concourse West, Brightwaters, NY 11718 seeks permission to construct an in-ground swimming pool, patio, roofed patio, two-story addition, retaining walls, walkways and expanded driveway in violation of Village Code Section 128-29A which limits the total building area (FAR) to 20% of the lot area, Applicant proposing 27.6%. In violation of Village Code 128-10 which requires a minimum roof pitch of five on twelve (5/12), Applicant proposing a roof pitch of zero on twelve (0/12) pitch.  In violation of Village Code 128-31 B(1) which requires a minimum rear yard set-back of 50 ft., Applicant proposing 48.0 ft.

PLEASE BE ADVISED that pursuant to the New York Governor’s Executive Order 202.1 issued on March 12, 2020, amending Article 7 of the Public Officers Law, to the extent necessary to permit any public body to meet and take such actions authorized by the law without permitting in-person public access to meetings, the Village of Brightwaters will conduct on this date a Zoning Board of Appeals Hearing without the public being present but will make available the means by which the public can view or listen to the hearings and the hearings will be recorded and transcribed.

The Public will be allowed to view and listen to the public hearings by utilizing ZOOM MEETING and a Meeting ID and Password will be provided upon request to the Village at deputyclerk@optonline.net

All applicants or their duly authorized representative are required to participate at this hearing at the time specified above.  All interested parties are welcome and will be given an opportunity to be heard.
