  ZONING BOARD OF APPEALS NOTICE OF PUBLIC HEARINGS

                NOTICE IS HEREBY GIVEN that the Zoning Board of Appeals of the Inc. Village of Brightwaters will hold a public hearing on Wednesday, May 26, 2021 at 7:30pm at Village Hall, 40 Seneca Drive, Brightwaters, New York 11718, to consider the following applications for variance relief:

Mr. & Mrs. Rainier Lehmann, 151 South Bay Avenue, Brightwaters, NY 11718 seek permission construct a new roofed patio, and two one-story additions in violation of Village Code 128-29 A, which limits the total building area (FAR) to 20% of the lot area, Applicants proposing 22.2% (19.11% existing).  In violation of Village Code 128-10, which requires a minimum roof pitch of five on twelve (5/12), Applicants proposing zero on twelve (0/12) pitch and a four on twelve (4/12) pitch.

Mr. Nicholas Cascio & Ms. Joanna Stankiewicz, 461 Manatuck Blvd., Brightwaters, NY 11718 seek permission to construct additions, an in-ground swimming pool, and patio in violation of Village Code 128-29 A, which limits the total building area to 20% of the lot area, Applicant proposing 22.27% (8.50% existing).  In violation of Village Code 128-10, which requires a minimum roof pitch of five on twelve (5/12), Applicant proposing three on twelve (3/12) pitch.

Adjourned case from April 28, 2021 hearing for Mr. Christopher Moro and Ms. Colleen Riley, 153 Concourse West, Brightwaters, NY 11718 seek permission to construct an elevated terrace in the front yard in violation of Village Code Section 128-22 A(1) which requires a building to be set back from a front property line a distance of 2 feet greater than the average setback of existing buildings within the block in question and on the same side of the street.  The required setback is 38.63 ft., Applicants proposing a front yard setback of 33.8 ft. (existing house setback = 43.7 ft., existing patio setback = 33.8 ft.). 

 

All applicants or their duly authorized representative are required to be at this hearing at the time specified above.  All interested parties are welcome and will be given an opportunity to be heard.
