 ZONING BOARD OF APPEALS NOTICE OF PUBLIC HEARING

NOTICE IS HEREBY GIVEN that the Zoning Board of Appeals of the Inc. Village of Brightwaters will hold a public hearing on Wednesday, September 28, 2022 at 7:30pm at Village Hall, 40 Seneca Drive, Brightwaters, New York 11718, to consider the following application for variance relief:

CONTINUATION OF PUBLIC HEARING HELD JULY 27, 2022:  Lisa and Jerome Cordero, 289 Lakeview Avenue West, Brightwaters, NY 11718, seek permission to construct a new swimming pool and patio in violation of Village Code Section 128-29 A, which limits the total building area (FAR) to 20% of the lot area, Applicants are proposing 25.43%; in violation of Village Code Section 128-31D, which limits the total rear yard building area (GAR) to 30% of the rear yard area, Applicants are proposing 39.29%; and in violation of Village Code Section 128-32 A, which requires that no accessory building shall be nearer any street property or side street property line than the principal building on the same lot, Applicants are proposing a patio and pool equipment to be located 13 feet from the Orchard Drive property line where the house is setback 30.21 feet.

Mr. Johnny Salazar, 341 Woodland Drive, Brightwaters, NY 11718, seeks permission to construct a 524 square foot deck in the rear yard in violation of Village Code Section 128-29 A, which limits the total building area (FAR) to 20% of the lot area, Applicant is proposing 22.27% (17.77% existing.)

Mr. & Mrs. Christian Martin, 91 Concourse West, Brightwaters, NY 11718 seek permission to construct a second floor addition with balcony in violation of Village Code Section 128-35A, which prohibits decks (balconies) from facing streets, Applicants are proposing a balcony that faces both Concourse West and Linwood Court; and in violation of Village Code Section 128-22 A(1), which requires a building to be set back from a front property line a distance of 2 feet greater than the average setback of existing buildings within the block in question and on the same side of the street.  The average setback on the block is 43.71 feet which results in a required setback of 45.71 feet, Applicants are proposing a front yard setback of 41.92 feet (existing house setback = 35.42 feet.)

All applicants or their duly authorized representative are required to be at this hearing at the time specified above.  All interested parties are welcome and will be given an opportunity to be heard.
