 ZONING BOARD OF APPEALS NOTICE OF PUBLIC HEARING

NOTICE IS HEREBY GIVEN that the Zoning Board of Appeals of the Inc. Village of Brightwaters will hold a public hearing on Wednesday, May 25, 2022 at 7:30pm at Village Hall, 40 Seneca Drive, Brightwaters, New York 11718, to consider the following application for variance relief:

CONTINUATION OF PUBLIC HEARING HELD MARCH 23, 2022:  David D. Busch, 90 West Main Street, Bay Shore, NY 11706, agent for owner, Aaron Rivera-Julka, 116 Concourse East, Brightwaters, NY 11718, seeks permission to construct a detached garage, pavilion, in-ground swimming pool, patios, and driveways in violation of Village Code Section 128-31 D, which limits the total rear yard building area (GAR) to 30% of the rear yard area, Applicant proposing 34.74% (19.3% existing). And in violation of Village Code Section 128-10, which requires a minimum roof pitch of five on twelve (5/12), Applicant proposing a roof pitch of zero on twelve (0/12).

Alice Baumer, 59 South Bay Avenue, Brightwaters, NY  11718, seeks permission to construct a new front stoop and to modify driveways and patios in violation of Village Code Section 128-29 A, which limits the total building area (FAR) to 20% of the lot area, Applicant proposing 26.2% (23.7% existing); and in violation of Village Code Section 128-31 D, which limits the total rear yard building area (GAR) to 35% of the rear yard area, Applicant proposing 42.7% (42.7% existing).

Nicholas Cascio, 461 Manatuck Blvd., Brightwaters, NY  11718, seeks permission to demolish an existing detached garage and construct a new pool house, pavilion and patio in violation of Village Code Section 128-29 A, which limits the total building area (FAR) to 20% of the lot area, Applicant proposing 26.05% (22.27% previous ZBA grant); and in violation of Village Code Section 128-32 C, which states accessory buildings must be at least 10 feet from side and rear property lines, Applicant proposing a side yard setback of 5.0 feet to the pool house.

All applicants or their duly authorized representative are required to be at this hearing at the time specified above.  All interested parties are welcome and will be given an opportunity to be heard.
