 ZONING BOARD OF APPEALS NOTICE OF PUBLIC HEARING
 
NOTICE IS HEREBY GIVEN that the Zoning Board of Appeals of the Inc. Village of Brightwaters will hold a public hearing on Wednesday, May 24, 2023 at 7:30pm at Village Hall, 40 Seneca Drive, Brightwaters, New York 11718, to consider the following application for variance relief:
 

Alexa and Tyler Schaper, 407 Potter Blvd., Brightwaters, NY  11718, seek permission to construct a one story addition and front porch in violation of Village Code Section 128-10, which requires a minimum roof pitch of five on twelve (5/12), Applicants are proposing a roof pitch of one and one half on twelve (1.5/12) on the rear addition and four on twelve (4/12) on the porch addition; in violation of Village Code Section 128-29A, which limits the total building area (FAR) to 20% of the lot area, Applicants are proposing 23.75% (15.53% existing); and in violation of Village Code Section 128-30A, which requires a minimum side yard of 10 feet and a minimum aggregate side yards of 25 feet, Applicants are proposing  9.7 feet minimum and 24.2 feet aggregate (9.7 feet and 24.2 feet existing).

Orinoco Realty, LLC, 8 Ocean Avenue, Bay Shore, NY 11706, seeks permission to construct a new building to house a pickleball facility at 245 Orinoco Drive, Brightwaters, NY, in violation of Village Code Section Section 128-31B(3), which requires a rear yard setback of 50 feet when the property abuts a Railroad Right-of-Way, Applicant is proposing a setback of 8.9 feet; in violation of Village Code Section 128-34, which limits the height of a building to 35 feet, Applicant is proposing a height of 37 feet -9 inches; and in violation  of  Village Code Section 128-44, which limits signage to one sign on the front of a place of business with a maximum size of 10 square feet, Applicant is proposing a total of 2 signs, each of which is 225 square feet.

All applicants or their duly authorized representative are required to be at this hearing at the time specified above.  All interested parties are welcome and will be given an opportunity to be heard.
