 ZONING BOARD OF APPEALS NOTICE OF PUBLIC HEARING
 
                NOTICE IS HEREBY GIVEN that the Zoning Board of Appeals of the Inc. Village of Brightwaters will hold a public hearing on Wednesday, May 22, 2024 at 7:30pm at Village Hall, 40 Seneca Drive, Brightwaters, New York 11718, to consider the following application for variance relief:
 
Paul Catoggio, 277 Woodland Drive, Brightwaters, NY  11718, seeks permission to construct a second story addition and new swimming pool, patios, pergola, shed and outdoor shower in violation of Village Code Section 128-29 A, which limits the total building area (FAR) to 20% of the lot area, Applicant is proposing 26.73%. (18.56% existing); in violation of Village Code Section 128-31D, which limits the total rearyard building area (GAR) to 30% of the rearyard area, Applicant is proposing 38.11% (23.71% existing); and in violation of Village Code 128-32C, which requires minimum side yards and rearyards of 10 feet for accessory structures, Applicant is proposing a side yard of 8.6 feet to an outdoor shower and 9.0 feet to a pergola and a rearyard of 8.6 feet to pool equipment.
 
CONTINUATION OF PUBLIC HEARING HELD APRIL 24, 2024 for Orinoco Realty, LLC, 8 Ocean Ave, Suite 3, Bay Shore, NY  11706, seeks permission to construct a new building at 245 Orinoco Drive, Brightwaters, NY 11718 in violation of Village Code Section 128-31B(3), which requires a rear yard setback of 50 feet when the property abuts a Railroad Right-of-Way, Applicant is proposing a setback of 5.5 feet; in violation of Village Code Section 128-44, which limits signage to one sign on the front of a place of business with a maximum size of 10 square feet, Applicant is proposing a total of 3 signs: 42 square foot wall mounted sign on the North (front) wall, 42 square foot wall mounted sign on the East side wall, 92 square foot wall mounted sign on the South rear wall; and in violation of Village Code Section 128-61, which limits the width of a primary driveway to 22 feet (flared to 27 feet at edge of pavement), Applicant is proposing 2 driveways - one being 14 feet wide flaring out to 24 feet at the edge of street pavement, the other being 27 feet wide flaring out to 64 feet at the edge of street pavement.
 
All applicants or their duly authorized representative are required to be at this hearing at the time specified above.  All interested parties are welcome and will be given an opportunity to be heard.
