INCORPORATED VILLAGE OF BRIGHTWATERS  ZONING BOARD OF APPEALS NOTICE OF PUBLIC HEARINGS 

                NOTICE IS HEREBY GIVEN that the Zoning Board of Appeals of the Inc. Village of Brightwaters will hold a public hearing using the computer program ZOOM MEETING on Wednesday February 24, 2021 at 7:30pm at Village Hall, 40 Seneca Drive, Brightwaters, New York 11718, to consider the following applications for variance relief:

Mr. and Mrs. James Nolan, 342 Woodland Drive, Brightwaters, NY 11718 seek permission to construct a new detached garage, alter the front porch, and construct a new rear yard deck in violation of Village Code 128-32C which requires accessory buildings to be at least 10 feet from side and rear property lines, Applicants proposing a rear yard setback of 4.0 feet (4.0 feet existing) and a side yard setback of 5.0 feet (3.0 feet existing).  Violation of Village Code 128-29A which limits the total building area to 20% of the lot area; Applicants proposing 23.88% (22.53% existing). Violation of Village Code 128-35D which requires that no deck shall be constructed or maintained in the rear 2/3 of the rear yard, Applicants proposing a deck setback of 25.42 feet, the required setback is 27.11 feet.

Mr. and Mrs. Todd Madison, 71 South Bay Avenue, Brightwaters, NY 11718 seek permission to expand the detached garage, remove a portion of the existing patio, and install an in-ground swimming pool in violation of Village Code 128-32C which requires accessory buildings to be at least 10 feet from side and rear property lines; Applicants proposing a rear yard setback of 5.83 feet (5.83 feet existing) and a side yard setback of 6.0 feet (6.0 feet existing).  Violation of Village Code 128-29A which limits the total building area to 20% of the lot area; Applicants proposing 27.02% (21.44% existing).  Violation of Village Code 128-31D which limits the total rear yard coverage (GAR) to 35%, Applicants proposing 37.63% (26.83% existing). 

PLEASE BE ADVISED that pursuant to the New York Governor’s Executive Order 202.1 issued on March 12, 2020, amending Article 7 of the Public Officers Law, to the extent necessary to permit any public body to meet and take such actions authorized by the law without permitting in-person public access to meetings, the Village of Brightwaters will conduct on this date a Zoning Board of Appeals Hearing without the public being present but will make available the means by which the public can view or listen to the hearings and the hearings will be recorded and transcribed.

The Public will be allowed to view and listen to the public hearings by utilizing ZOOM MEETING and a Meeting ID and Password will be provided upon request to the Village at deputyclerk@optonline.net All applicants or their duly authorized representative are required to participate at this hearing at the time specified above.  All interested parties are welcome and will be given an opportunity to be heard.
