 ZONING BOARD OF APPEALS NOTICE OF PUBLIC HEARING
 
NOTICE IS HEREBY GIVEN that the Zoning Board of Appeals of the Inc. Village of Brightwaters will hold a public hearing on Wednesday, August 9, 2023 at 7:30pm at Village Hall, 40 Seneca Drive, Brightwaters, New York 11718, to consider the following application for variance relief:
 
Michael Dunn, Architect, 256 Orinoco Drive, Suite B, Brightwaters, NY 11718, property owner Ahmed Shihabudeen, 522 Lombardy Blvd., Brightwaters, NY 11718, seeks permission to construct first and second story additions and a covered front porch on the premises located at 522 Lombardy Blvd. in violation of Village Code Section 128-29 A., which  limits the total building area (FAR) to 20% of the lot area, Applicant is proposing 26.75%; in violation of Village Code Section 128-22 A(1), which requires a building to be set back from a front property line a distance of 2 feet greater than the average setback of existing buildings within the block in question and on the same side of the street, the average setback on your block of Lombardy Blvd. is 25.75 ft. which results in a required setback of 27.75 ft., Applicant is proposing a front yard setback of 22.9 ft. (existing setback = 29.9 ft.); and in violation of Village Code Section 128-31 B(1), which requires a minimum rear yard setback of 50 ft., Applicant is proposing a front yard setback of 30.6 ft. (existing house setback = 36 ft.)
 
All applicants or their duly authorized representative are required to be at this hearing at the time specified above.  All interested parties are welcome and will be given an opportunity to be heard.
