ZONING BOARD OF APPEALS NOTICE OF PUBLIC HEARING
 
                NOTICE IS HEREBY GIVEN that the Zoning Board of Appeals of the Inc. Village of Brightwaters will hold a public hearing on Wednesday, September 27, 2023 at 7:30pm at Village Hall, 40 Seneca Drive, Brightwaters, New York 11718, to consider the following application for variance relief:
 
Dylan Cortina, 10 Mohawk Drive, Brightwaters, NY  11718, seeks permission to construct a 430 square foot addition to the rear yard patio in violation of Village Code Section 128-29A, which limits the total building area (FAR) to 20% of the lot area, Applicant is proposing 22.76% (19.85% existing).
 
CONTINUATION OF PUBLIC HEARING HELD MAY 24, 2023: amended application of Orinoco Realty, LLC, 8 Ocean Avenue, Bay Shore, NY 11706, seeking permission to construct a new building to house a pickleball facility at 245 Orinoco Drive, Brightwaters, NY, in violation of Village Code Section 128-31B(3), which requires a rear yard setback of 50 feet when the property abuts a Railroad Right-of-Way, Applicant is proposing an amended setback of 5.5 feet; in violation of Village Code Section 128-44, which limits signage to one sign on the front of a place of business with a maximum size of 10 square feet, Applicant is proposing an amended request  for a total of 4 signs - 10 square feet, 42 square feet, 42 square feet, and 183 square feet; and in violation of Village Code Section 128-61C, which limits the width of a primary driveway to 22 feet, Applicant is proposing 2 driveways, each of which are 24 feet wide flaring out to 64.6 feet at the edge of street pavement.
 
All applicants or their duly authorized representative are required to be at this hearing at the time specified above.  All interested parties are welcome and will be given an opportunity to be heard.
