 ZONING BOARD OF APPEALS NOTICE OF PUBLIC HEARING
 
                NOTICE IS HEREBY GIVEN that the Zoning Board of Appeals of the Inc. Village of Brightwaters will hold a public hearing on Wednesday, November 29, 2023 at 7:30pm at Village Hall, 40 Seneca Drive, Brightwaters, New York 11718, to consider the following application for variance relief:
 
James and Kimberly Laricchiuta, 446 Peters Blvd., Brightwaters, NY  11718, seek permission to construct a one story addition and front and rear porches in violation of Village Code Section 128-10, which requires a minimum roof pitch of five on twelve (5/12), Applicants are proposing a roof pitch of two on twelve (2/12) on the one story addition and the front porch addition; in violation of Village Code Section 128-22 A(1), which requires a building to be set back from a front property line a distance of 2 feet greater than the average setback of existing buildings within the block in question and on the same side of the street.  The average setback on the block is 28.84 ft. which results in a required setback of 30.84 ft., Applicants are proposing a front yard setback of 26.71 ft. (existing house setback = 30.38 ft.); in violation of Village Code Section 128-29 A, which limits the total building area (FAR) to 20% of the lot area, Applicants are proposing 26.04%. (16.04% existing); and in violation of Village Code Section 128-30A, which requires a minimum side yard of 10 ft. and a minimum aggregate side yards of 25 ft., Applicants are proposing aggregate side yards of 20.0 ft . (10.0 ft. and 18.42 ft. existing).
 

Michael Demeno of Speed Master Marine Performance, for 103 Orinoco Drive, Brightwaters, NY  11718 (SCTM# 0501-006-01-049), seeks an interpretation of Village Code Section 128-13.3 to determine if boat fabrication should be included in one of the automotive related uses that are permitted by the Code.

All applicants or their duly authorized representative are required to be at this hearing at the time specified above.  All interested parties are welcome and will be given an opportunity to be heard.
