ZONING BOARD OF APPEALS NOTICE OF PUBLIC HEARING
NOTICE IS HEREBY GIVEN that the Zoning Board of Appeals of the Inc. Village of Brightwaters will hold a public hearing on Wednesday, June 25, 2025 at 7:30pm at Village Hall, 40 Seneca Drive, Brightwaters, New York 11718, to consider the following application for variance relief:
Michael Khoury, 52 Concourse East, Brightwaters, NY 11718, seeks permission to construct a swimming pool, raised patio, retaining walls, deck, pool house and second floor balcony in violation of Village Code Section 128-29A, which limits the total building area (FAR) to 20% of the lot area, Applicant is proposing 24.4%; in violation of Village Code Section 128-31D, which limits the total rear yard building area (GAR) to 30% of the rear yard area, Applicant is proposing 52.22 %; in violation of Village Code Section 128-34B, which limits the height of an accessory building to 24 feet, Applicant is proposing 25’-5” from the average crown of road to top of pool house; in violation of Village Code Section 128-6E, which limits accessory buildings to 1-1/2 stories, Applicant is proposing a 2-story pool house; in violation of Village Code Section 128-35A, which prohibits decks (balconies) from facing streets, Applicant is proposing a balcony which faces both Concourse East and Marine Court; and in violation of Village Code Section 128-35C, which limits the depth of a second floor deck/balcony to 8 feet, Applicant is proposing 16.1 feet.
All applicants or their duly authorized representative are required to be at this hearing at the time specified above. All interested parties are welcome and will be given an opportunity to be heard.
